First Cherokee State Bank Internet Privacy Statement
This Privacy Statement applies to First Cherokee State Bank (the "Bank") and/or Cherokee National Trust, LLC ("CNT"), as applicable. If you are a customer of CNT, the terms "we," "us" and "our" refer to CNT; if you are a customer of the Bank, these terms refer to the Bank. If you are a customer of both the Bank and CNT, these terms mean the Bank when relating to your relationship with the Bank, and mean CNT when relating to your relationship with CNT.
We recognize and respect the privacy and security expectations of our customers. As our customer, you have entrusted us to protect your privacy and to safeguard your personal financial information. We take this responsibility seriously and have taken steps to ensure your continued confidence in our institution.
This Privacy Statement describes how we collect and use your personal information and how we maintain the confidentiality and accuracy of such information. This disclosure also explains how you can verify the accuracy of information regarding your relationship with us. This disclosure applies to our former customers as well as to our existing customers.
Nonpublic Personal Information. This Privacy Statement relates primarily to our use of nonpublic personal information. Nonpublic personal information means financial information that relates specifically to you and that is not available from a public source (such as government records, phone books, or widely distributed media). Nonpublic personal information also includes any list, description, or other grouping of customers that is created using nonpublic information.
Affiliates. Portions of this Privacy Statement refer to sharing of information with "affiliates." A company is an "affiliate" of another company if it is controlled by, controls or is under common control with the other company. For example, CNT and the Bank are affiliates of one another.
How We Obtain Personal Customer Information and What We Collect. We collect nonpublic personal information about you from the following sources:
- Information we receive from you on applications or other forms.
- Information about your transactions with us, our affiliates or others.
- Information we receive from a consumer-reporting agency.
- Information we receive from others whom you authorize us to contact in reviewing your applications or transactions with us.
We collect and maintain various types of information about our customers, including:
- Identifying information, such as social security numbers, driver's license numbers, account numbers, names, addresses, and personal identification numbers (PINs) and passwords.
- Information regarding your creditworthiness and capacity, such as employment status, income, and information on your assets and liabilities that you provide to us in your applications.
- Account activity information, such as deposit account, trust account, and loan balances and transaction histories.
- Information about your transactions and experiences with us, such as your payment or overdraft history.
How We Use Your Personal Information. We disclose your personal information only for our legitimate business purposes and in compliance with all applicable laws and regulations. The following summarizes the principal ways in which we disclose your personal information.
Use Of Information with Our Affiliates. We share some of your information (as described below) with our affiliates in order to provide you with information about additional products and services and to protect the security of your investments, accounts and loans with us or another affiliate. Our affiliates are financial service providers. The Bank's affiliates include trust companies, investment service companies, and financial planning companies. CNT's affiliates include a bank, securities broker-dealers, investment service companies, and financial planning companies.
We may share the following types of information about you with our affiliates:
- Your identifying information, such as your social security number, driver's license number, account number, name, and address.
- Information about your transactions and experiences with us, such as your payment or overdraft history, account activity information, investment, deposit and loan balances, and transaction histories.
We are permitted by law to share this information. With your written consent, we also may share the following information with our affiliates:
- Information we receive from you on an application (or materials provided with your application) concerning your income, assets, or liabilities to persons who are not affiliated with us.
- Information we receive about you from a consumer-reporting agency, such as creditworthiness and credit history information relating to your transactions with others.
- All of the information that we collect, as described above, when you have provided your written consent for us to share information with that specific affiliate.
Disclosure to Nonaffiliated Third Parties. We may disclose information about you, including nonpublic personal information, to nonaffiliated third parties (persons who are not our affiliates) as described below. We are permitted by law to share the following information for the following purposes:
- To service providers. We may disclose all of the information we collect, as described above, to companies that provide services for us, such as ATM providers, printing companies, check printers, loan or account processors or servicers, and mail processing companies. We require that these service providers maintain the confidentiality of your information and that they use the information only for the purposes for which we have provided it.
- For marketing purposes. We may disclose all of the information we collect, as described above, to companies that perform marketing services on our behalf. We also may disclose all of the information relating to our transactions and experiences with you to financial institutions with whom we have joint marketing agreements, including our private label credit card provider. "Financial institutions" include banks, savings associations, other lenders, insurance agents and companies, securities broker-dealers, investment advisors, and other companies providing financial products or services. Whenever we disclose your information to another company, whether for marketing on our behalf or under joint marketing arrangements with other financial institutions, we require that these companies and financial institutions maintain the confidentiality of your information and that they use the information only for the purposes for which we have provided it.
- For legal requirements. We may use all of the information we collect, as described above, to satisfy legal requirements. For example, we will use your social security number for income tax reporting purposes. We also will share your nonpublic personal information with government agencies and legitimate investigators as required or allowed by law, including in order to comply with applicable government reporting or legal process (such as court orders, subpoenas, or government requests) which we reasonably believe to be valid or required.
- To consumer reporting (credit reporting) agencies. We may disclose information relating to our transactions or experiences with you to consumer reporting agencies and similar organizations.
- With your consent. We may disclose all of the information that we collect, as described above, with any person when you have provided your written consent for us to do so, including when you give someone a power of attorney or other authorization to act on your behalf.
- Joint applicants, guarantors, and joint accountholders. We may disclose information about your loans or accounts with us, and your transactions or payments with respect to such loans or accounts, to persons who jointly own such accounts or who are your co-borrowers or guarantors. We also may disclose information concerning your credit history to persons who are co-applicants with you, but only if we find it necessary to decline your application or to later take an adverse action with respect to your loan or account.
Account Numbers, PINs, Access Codes. In no event will we share your account numbers, PINs or similar access codes to third parties for any marketing purposes without your authorization.
Protecting The Security Of Your Information. Your privacy is considered in all aspects of our business. We have established policies and guidelines to ensure that the highest level of protection is maintained. We constantly update these policies to meet changing federal regulations and the latest in Internet security standards, and we update and test our computers, hardware, software and other technology to assure the integrity and security of our systems. We also limit access of our employees to personally identifiable information about you to those employees who have a specific business reason to know such information.
Accuracy Of Customer Information. We believe that it is important to maintain the accuracy of all of your information with us. We have systems designed to ensure this accuracy and to correct any information that we learn to be inaccurate.
